The Denman Island Local Trust Committee adopts a policy restricting bylaw enforcement where guest accommodation provides a second set of cooking facilities in a lawful dwelling or uses accessory buildings as bedrooms, provided no more than three bedrooms exist in total. The policy expires on December 31, 2012, or when the guest accommodation regulation review is complete, whichever is sooner. 1
Enforcement is not restricted where there are health, safety or environmental-damage issues, or a written complaint about bona fide serious nuisance issues such as noise or parking congestion related to the guest accommodation. The policy says it does not give permission to violate the Land Use Bylaw, and the committee may change it or direct expanded enforcement activities without notice. 1
Bylaw Enforcement Coordinator Miles Drew said the bylaws are not being amended and that the policy restricts enforcement to certain circumstances. Chair Peter Luckham described the policy as a short-term working solution and said he was uncomfortable with adjusting bylaws in this manner. 1
The committee also directs staff to add a review of Land Use Bylaw regulation on guest accommodation to its projects list. Trustee Laura Busheikin encourages Denman WORKS! to use the time provided by the policy to gather statistics and consult community voices. 1
The meeting takes place on May 1, 2012, at the Denman Seniors Hall, with nineteen members of the public in attendance. 1
