Denman trustees seek revised marine bylaw

The committee asked staff to consult legal counsel on redrawing Bylaw No. 207 within the Local Trust Committee’s jurisdiction and report back.

Staff will consult legal counsel on whether Bylaw No. 207 can be redrawn within the Local Trust Committee’s jurisdiction, then report back to the committee. Trustees carried a motion requesting the revised draft after discussing legal limits and possible next steps for the proposed marine bylaw.[1]

The staff report had recommended that the committee not proceed with Bylaw No. 207, based on advice from the Islands Trust solicitor, and suggested considering other avenues in the Official Community Plan. Staff also said Trust Area Services was reviewing marine-protection options at a broader level.[1]

During discussion, one trustee supported the staff report’s approach, saying the initiative had not reached a conclusion despite years of efforts, stakeholder meetings and legal advice. Another trustee argued the bylaw could be amended to address land use within the committee’s authority and advocate against driving on beaches.[1]

The carried motion asks staff to consult legal counsel and assess whether the proposed bylaw can be amended to an acceptable legal framework; the minutes say the committee could decide not to proceed if that is not possible.[1]
