Denman trustees stop work on proposed aquaculture bylaw

The Denman Island Local Trust Committee votes to proceed no further with Draft Bylaw No. 207 because of questions regarding legislative authority. The proposed bylaw would ban beach modification, driving on the foreshore and predator netting from the beach. [1]

Planning staff report that 25 referrals are sent and nine responses are received. The Tenuring Branch of Forests Lands and Natural Resource Operations has not responded, while the BC Shellfish Growers Association gives non-approval. [1]

Trustee Busheikin says a previous legal review determines that the committee has no legal authority to ban aquaculture-oriented beach activities. The minutes record discussion that the proposed bans may be beyond the committee’s scope. [1]

Trustee Graham prefers deferring further consideration until referral comments are received from the FLNRO Tenures Branch, and suggests seeking a more detailed response from the Aquaculture Management Branch of the Department of Fisheries and Oceans. Chair Luckham prefers not proceeding because of questions about legislative authority. [1]
