Denman trustees request legal report on eviction orders

The Local Trust Committee also changes its standing resolution on bylaw enforcement against unlawful dwellings.

The Denman Island Local Trust Committee requests a report on whether staff have the legal authority to issue eviction orders for residential tenancies. ^[1]

Bylaw Compliance and Enforcement Manager Warren Dingman says staff are not issuing eviction notices and that it is not clear whether the department has the legislative authority to do so. ^[1]

The committee carries a resolution removing the sentence, “This Standing Resolution will be reviewed in one year’s time,” from its standing resolution on bylaw enforcement against unlawful dwellings. ^[1]

The committee also requests a report on current or open files early in the next term and rescinds Standing Resolution No. 9 DE-IC-2021-002. ^[1]

The amended resolution says site inspections for gathering information and communicating with property owners will continue, and that the committee may change the policy at any time and direct staff to resume enforcement activities. ^[1]
