Denman trustees defer part of bylaw enforcement amendment

The committee removed most listed bylaws from a penalty schedule and deferred a separate decision on short-term vacation rentals.

The Denman Island Local Trust Committee voted to remove all bylaws from Schedule A of its Bylaw Enforcement Notification Bylaw’s contraventions and penalties section, except the Short Term Vacation Rental Bylaw. ^[1] The committee deferred consideration of amending Schedule B to its next meeting. ^[1]

Bylaw Compliance and Enforcement Manager Warren Dingman said the proposed amendment would enforce the Siting and Use Bylaw, correct errors and add a contravention for failing to permit an inspection under section 1.3.7 of the Land Use Bylaw. ^[1] He said the inspection provision was not a new law and had been omitted in error, and that the amendment was within the committee’s authority. ^[1]

Trustees discussed the effect of fines on low-income residents and suggested limiting infractions to Short Term Vacation Rentals, which the minutes describe as a practice that generates income for operators. ^[1] The minutes also record that compliance is achieved most of the time and that, without the notification-bylaw system, the committee can authorize legal action if necessary. ^[1]

During public comments, the Denman Island Housing Action Group requested that the proposed amendments be referred to the Housing Advisory Planning Commission for consideration and discussion. ^[1] A public speaker objected to the bylaw-enforcement power to impose fines if access without notice is refused and asked the committee not to introduce additional fines. ^[1]
